Understanding the New NJ Buyer Requirements
The process of working with a real estate agent in New Jersey has changed. As of August 2024, state law now requires a signed Buyer’s Agency Agreement before an agent can show you a home privately.
This is not a company policy—it is a legal requirement designed to protect you as a buyer.
Why This Benefits You
While this may feel like an extra step, it is actually one of the most important protections you have.
A Buyer’s Agency Agreement ensures:
Transparency – You clearly understand the services being provided and how your agent is compensated
Representation – Your agent is legally required to act in your best interest
Confidentiality – Your financial position and negotiation strategies are protected
This agreement creates a professional relationship focused entirely on your goals.
Your Options
Not all agreements are the same, and you have flexibility in how you choose to move forward:
Exclusive Buyer Agency – A dedicated agent working with you throughout your search
Non-Exclusive Agency – Flexibility to work with different agents (ex: North and South NJ)
One-Time Showing Agreement – Coverage for a single property showing
We will walk you through these options so you can choose what feels right for you.
Open Houses and Representation
You can still visit Open Houses without signing an agreement.
However, it’s important to understand that the agent hosting the Open House represents the seller—not you. Any information you share can be relayed back to the seller.
Without your own representation, you are navigating the process on your own.
Working Directly with the Listing Agent
It is possible to work directly with the listing agent, but this creates what is known as dual agency. In this situation, the agent represents both the buyer and the seller and must remain neutral. This means they cannot fully advocate or negotiate on your behalf.
For most buyers, having dedicated representation provides stronger protection and better support throughout the process.
